Many buyers avoid such apartments, considering them problematic or less reliable. In practice, however, this <strong>one of the most mythologized, but at the same time absolutely normal types of property<\/strong>.<\/p>\n\n\n\n<p>In this article I explain in simple terms, <strong>what is sp\u00f3\u0142dzielcze w\u0142asno\u015bciowe kvartira<\/strong>, why don&#039;t the Poles see it as a problem and why in some regions, especially in <strong>Tricity (Gdansk, Gdynia, Sopot)<\/strong>, There is a real \u00abhunt\u00bb for such apartments.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a sp\u00f3\u0142dzielcze w\u0142asno\u015bciowe kvartira in simple words<\/h2>\n\n\n\n<p>Sp\u00f3\u0142dzielcze w\u0142asno\u015bciowe pravo means that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the building and land belong <strong>housing cooperative (sp\u00f3\u0142dzielnia)<\/strong>,<\/li>\n\n\n\n<li>the owner of the apartment has <strong>ownership of a specific locale<\/strong>,<\/li>\n\n\n\n<li>this right can be <strong>sell, buy, give away, and pass on by inheritance<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>In fact, the owner of such an apartment <strong>uses it the same way<\/strong>, as with full ownership (pe\u0142na w\u0142asno\u015b\u0107). The restrictions are mainly <strong>legal rather than practical in nature<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Poles don&#039;t consider this form of ownership problematic<\/h2>\n\n\n\n<p>The most revealing thing is - <strong>Polish citizens in most cases do not see the problem at all<\/strong> in sp\u00f3\u0142dzielczej form of ownership.<\/p>\n\n\n\n<p>This is related to the history of the real estate market:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>such houses were built en masse in <strong>1970s\u20131990s<\/strong>,<\/li>\n\n\n\n<li>entire residential areas were handed over in this form,<\/li>\n\n\n\n<li>Today there are a huge number of such apartments <strong>passed down by inheritance<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>For Poles, sp\u00f3\u0142dzielcze w\u0142asno\u015bciowe housing is <strong>usual and customary form of ownership<\/strong>, not risk or \u00absecond category\u00bb.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Lack of ksi\u0119gi wieczystej \u2013 is it really a problem?<\/h2>\n\n\n\n<p>One of the most common myths is that if an apartment doesn&#039;t have ksi\u0119gi wieczystej, there&#039;s something wrong with it.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What this looks like in practice:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>absence of ksi\u0119gi wieczystej <strong>does not discredit the apartment<\/strong>,<\/li>\n\n\n\n<li><a href=\"https:\/\/rutkowskihome.pl\/en\/uslugi\/pokupka-i-prodazha-nedvizhimosti\/\" data-type=\"page\" data-id=\"16\">when purchasing<\/a> the notary files an application with the court to open it,<\/li>\n\n\n\n<li>This <strong>normal and standard procedure<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>The seller&#039;s right to the apartment is verified on the basis of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>documents from sp\u00f3\u0142dzielni,<\/li>\n\n\n\n<li>official certificates and registers,<\/li>\n\n\n\n<li>\u0438 <strong>necessarily by a notary<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>To be afraid of such apartments <strong>not worth it<\/strong>, if the deal <a href=\"https:\/\/rutkowskihome.pl\/en\/kontakty\/\" data-type=\"page\" data-id=\"30\">accompanied by a specialist<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is it possible to change the form of ownership after purchase?<\/h2>\n\n\n\n<p>Yes - and this is another important point that is often kept silent about.<\/p>\n\n\n\n<p>After purchasing an apartment:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>form of ownership <strong>can be changed<\/strong>,<\/li>\n\n\n\n<li>you can open ksi\u0119g\u0119 wieczyst\u0105,<\/li>\n\n\n\n<li>in some cases it is possible to transform into <strong>full ownership (pe\u0142na w\u0142asno\u015b\u0107)<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>These are standard legal procedures that <strong>are not something complicated or dangerous<\/strong> with proper accompaniment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Remodeling and window replacement: do you need a sp\u00f3\u0142dzielni permit?<\/h2>\n\n\n\n<p>You can often hear the opinion that <strong>in sp\u00f3\u0142dzielczej apartment for any changes you need permission sp\u00f3\u0142dzielni<\/strong>, while with full ownership one can supposedly do whatever one wants.<\/p>\n\n\n\n<p>\u2757 <strong>This is a myth.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What is reality really?<\/h3>\n\n\n\n<p>And at the sp\u00f3\u0142dzielczej form of ownership, and at <strong>full ownership (pe\u0142na w\u0142asno\u015b\u0107)<\/strong> Similar rules apply:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>if the changes affect <strong>supporting structures<\/strong>, risers or engineering systems,<\/li>\n\n\n\n<li>if it changes <strong>exterior appearance of the facade<\/strong> (for example, windows, balcony),<\/li>\n\n\n\n<li>if the work may affect other residents,<\/li>\n<\/ul>\n\n\n\n<p>\u27a1\ufe0f <strong>consent is always required<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>or sp\u00f3\u0142dzielni,<\/li>\n\n\n\n<li>or <strong>wsp\u00f3lnoty mieszkaniowej<\/strong> (with full ownership).<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">What can usually be done without approvals?<\/h3>\n\n\n\n<p>In most cases <strong>allowed without any problems<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>demolition of non-load-bearing partitions,<\/li>\n\n\n\n<li>interior redevelopment of the apartment,<\/li>\n\n\n\n<li>window replacement &quot;window to window&quot; sp\u00f3\u0142dzielczych apartments is most often spread <strong>in cities not located in the border zone<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The real situation in the Tricity<\/h3>\n\n\n\n<p>\u0412 <strong>Tricity (Gdansk, Gdynia, Sopot)<\/strong> the situation is exactly the opposite:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>demand from foreigners <strong>very tall<\/strong>,<\/li>\n\n\n\n<li>there is a real &quot;hunt&quot; for apartments,<\/li>\n\n\n\n<li>sellers and agents <strong>They specifically emphasize this form of ownership in their advertisements<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>In practice:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a good option for renting an apartment <strong><a href=\"https:\/\/rutkowskihome.pl\/en\/uslugi\/pokupka-i-prodazha-nedvizhimosti\/\" data-type=\"page\" data-id=\"16\">sells faster<\/a><\/strong>, than a similar apartment with full ownership,<\/li>\n\n\n\n<li>many foreign buyers <strong>they are deliberately waiting for the appearance of exactly such objects<\/strong>,<\/li>\n\n\n\n<li>the demand for them in the region is consistently high.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Mortgage for a new apartment \u2013 is it possible?<\/h2>\n\n\n\n<p>Another common myth is that <strong>sp\u00f3\u0142dzielcze w\u0142asno\u015bciowe apartment is impossible <\/strong><a href=\"https:\/\/rutkowskihome.pl\/en\/uslugi\/ipotechnoe-soprovozhdenie\/\" data-type=\"page\" data-id=\"18\"><strong>buy with a mortgage<\/strong>.<\/a> In practice this is <strong>does not correspond to reality<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What does this look like in practice?<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the apartment <strong>already there is ksi\u0119ga wieczysta<\/strong>, most banks are considering such real estate <strong>on the same terms<\/strong>, as well as apartments with full ownership.<\/li>\n\n\n\n<li>If <strong>ksi\u0119gi wieczystej no<\/strong>, then during the purchase process:\n<ul class=\"wp-block-list\">\n<li>the notary files an application with the court to open it,<\/li>\n\n\n\n<li>after opening ksi\u0119gi wieczystej the bank can register the mortgage,<\/li>\n\n\n\n<li>This <strong>standard and widely used procedure<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>It is important to understand that the bank always analyzes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>legal status of real estate,<\/li>\n\n\n\n<li>status of the land plot,<\/li>\n\n\n\n<li>documents issued by a housing cooperative (sp\u00f3\u0142dzielni\u0105).<\/li>\n<\/ul>\n\n\n\n<p>At <strong>correctly performed procedure<\/strong> sp\u00f3\u0142dzielcze w\u0142asno\u015bciowe apartment <strong>it can be done without any problems <\/strong><a href=\"https:\/\/rutkowskihome.pl\/en\/uslugi\/ipotechnoe-soprovozhdenie\/\" data-type=\"page\" data-id=\"18\"><strong>financed by a mortgage loan<\/strong>.<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why are foreigners actively buying apartments in the sp\u00f3\u0142dzielcze region?<\/h2>\n\n\n\n<p>Among foreign buyers, sp\u00f3\u0142dzielcze w\u0142asno\u015bciowe apartments are popular <strong>increasingly popular<\/strong>. This is due to a number of practical advantages that are often overlooked.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Main reasons:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>no need to receive <a href=\"https:\/\/rutkowskihome.pl\/en\/uslugi\/razreshenie-na-pokupku-nedvizhimosti\/\" data-type=\"page\" data-id=\"20\">MSWiA resolution<\/a><\/strong> for the purchase of real estate;<\/li>\n\n\n\n<li><strong>a simpler and faster transaction procedure<\/strong> compared to other forms of ownership;<\/li>\n\n\n\n<li><strong>good locations and good footage<\/strong>, especially in old buildings;<\/li>\n\n\n\n<li><strong>high liquidity in the secondary market<\/strong>, especially in large cities and border regions.<\/li>\n<\/ul>\n\n\n\n<p>For many foreigners <strong>sp\u00f3\u0142dzielcze w\u0142asno\u015bciowe housing is the most accessible and logical way <\/strong><a href=\"https:\/\/rutkowskihome.pl\/en\/uslugi\/pokupka-i-prodazha-nedvizhimosti\/\" data-type=\"page\" data-id=\"16\"><strong>buying real estate in Poland<\/strong>.<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion: Don&#039;t trust pseudo-experts<\/h2>\n\n\n\n<p>If you are told that <strong>sp\u00f3\u0142dzielcze w\u0142asno\u015bciowe apartments are worse<\/strong>, ask a simple and logical question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>If in the same building, for example built in 1980, there are two identical apartments,<br>one is a sp\u00f3\u0142dzielcza, and the other is a full-fledged property owner, \u2014 <strong>How exactly is the first one worse?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>To this question <strong>there is almost never a reasonable answer<\/strong>.<\/p>\n\n\n\n<p>The form of ownership is a question <strong>legal registration<\/strong>, and not the quality of housing.<br>With proper verification of documents and support from a notary or an experienced realtor <strong>sp\u00f3\u0142dzielcze w\u0142asno\u015bciowe apartment is a safe, liquid and often very profitable purchase<\/strong>.<\/p>\n\n\n\n<p>If you are planning to buy real estate in Poland and want to understand the forms of ownership, <a href=\"https:\/\/rutkowskihome.pl\/en\/kontakty\/\" data-type=\"page\" data-id=\"30\"><strong>It&#039;s better to do this before signing any documents.<\/strong>.<\/a><\/p>\n\n\n\n<p><\/p>","protected":false},"excerpt":{"rendered":"<p>The right to an apartment is one of the most misunderstood forms of property ownership in Poland, especially among foreigners.
